Terms of Use
Effective 26 September 2026
The short version: OneSober is a private drink diary and sober-day tracking tool, not medical care or treatment. Your diary is local-first and may synchronize through your private iCloud account. Your decisions about alcohol, health, and safety remain your responsibility.
1. Agreement and App Store licence
These Terms of Use ("Terms") are between you and Neon Tiger Labs LLC, a California limited liability company ("we," "us," "our"), and govern your use of the OneSober iOS app (the "App") and onesober.app (the "Site"). If you do not agree, do not use the App or Site.
The App is licensed, not sold. Unless the App Store listing identifies a separate custom end-user licence agreement, Apple’s Standard Licensed Application End User License Agreement (the "Standard EULA") governs the App licence. These Terms supplement the Standard EULA. If they conflict on a matter the Standard EULA controls, the Standard EULA governs that matter.
2. What OneSober is
OneSober is a personal drink diary with a first-class sober-day layer. It lets you record drinks, mark sober days, add notes or photos, review and correct Calendar history, configure personal goals, and export your own records.
The App is intended to help you keep your own record. It does not know your complete health history, circumstances, or risk level.
3. What OneSober is not
OneSober counts; it does not counsel. The App and Site are not medical services, treatment, diagnosis, emergency guidance, or individualized health advice. They are not designed to determine whether you are impaired or whether changing your alcohol use is medically safe. Nothing in the App or Site should be used to decide whether it is safe to drive, operate machinery, drink more alcohol, make an abrupt health-related change, or delay professional care.
If you believe you may have a medical emergency, contact local emergency services. If you have questions about medication, pregnancy, changing alcohol use, or another health condition, seek advice from a qualified healthcare professional rather than relying on the App.
4. Eligibility and lawful use
You must be legally able to enter into a binding agreement to accept these Terms. You are responsible for complying with the laws that apply to you, including laws concerning alcohol possession, purchase, consumption, driving, and age restrictions. The App does not grant permission to buy, possess, or consume alcohol.
5. Your diary content
Your drink entries, sober-day marks, notes, photos, saved presets, goals, and other user-entered content remain yours. You are responsible for the accuracy of what you enter and for having the rights needed to store or share any photos or other content you add.
OneSober may calculate totals and summaries from your records. Those derived views are informational summaries of the data you entered and are not medical conclusions.
6. Local-first storage and private iCloud sync
OneSober stores diary data locally on your device. When iCloud is available, supported records and attached photo data may synchronize through the private CloudKit database associated with your Apple account. Neon Tiger Labs does not operate a OneSober account or application server that receives your diary and does not have application-level access to your private CloudKit records. See the Privacy Policy for current data-path details.
Uninstalling the App removes its local data from that device but does not necessarily remove synchronized records already stored in your iCloud account. You are responsible for maintaining access to your devices, Apple account, and any exports or backups you choose to keep.
7. Export, photos, and sharing
When you export your diary or share content from the App, the selected content is handed to iOS or to the destination you choose. You are responsible for content after it is sent to another app, person, or service. Photos you attach to diary entries are subject to the same responsibilities and may synchronize through private CloudKit as described above.
8. App Lock and device security
If available, App Lock uses Apple’s system authentication to add a local access barrier. It does not make the App or device immune to compromise and is not a substitute for maintaining a secure device, Apple account, passcode, or backups.
9. Acceptable use
You agree not to:
- Use the App or Site for an unlawful purpose or to violate another person’s rights
- Use the App as a substitute for emergency, medical, driving-safety, or other professional judgment
- Attempt to access systems or data that are not intended for you
- Reverse engineer, decompile, disassemble, or attempt to derive source code except to the extent applicable law expressly permits despite this restriction
- Redistribute, sublicense, rent, lease, or resell the App except as permitted by the Standard EULA or applicable law
10. Intellectual property
Your user-entered content remains yours. OneSober, including its software, design, copy, documentation, branding, and Site content, is owned by Neon Tiger Labs LLC or its licensors and is protected by applicable intellectual-property law. No rights are granted except the limited rights expressly provided by these Terms, the Standard EULA, and applicable law.
11. App and Site changes
We may update the App, change or discontinue features, stop offering future downloads, or stop maintaining the Site. We do not promise that every export format, goal feature, reminder, or device capability will remain available forever.
12. Warranty disclaimer
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE APP AND SITE ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that diary totals, reminders, synchronization, or other features will be uninterrupted, error-free, complete, or suitable for a health, driving, legal, or safety decision.
13. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NEON TIGER LABS LLC WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST DATA, HEALTH OUTCOMES, DRIVING OR SAFETY DECISIONS, OR OTHER LOSSES ARISING FROM OR RELATED TO THE APP, SITE, OR THESE TERMS.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR AGGREGATE LIABILITY FOR CLAIMS ARISING FROM THE APP, SITE, OR THESE TERMS WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID TO ACCESS ONESOBER DURING THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR US$100. Some jurisdictions do not allow certain warranty exclusions or liability limitations, so some of the above may not apply to you.
14. Indemnification
To the extent permitted by applicable law, you agree to indemnify and hold harmless Neon Tiger Labs LLC and its officers, employees, and agents from third-party claims arising from your unlawful use of the App or Site, your violation of these Terms, or your infringement of another person’s rights.
15. Governing law
These Terms are governed by the laws of the State of California, United States, without regard to conflict-of-law rules, except to the extent mandatory consumer law in your place of residence provides otherwise. Any court proceeding must be brought in a court with lawful jurisdiction over the dispute.
16. Changes to these Terms
We may update these Terms as the product, Site, or legal requirements change. We will update the effective date and, where appropriate, provide additional notice of material changes. Continued use after revised Terms take effect constitutes acceptance to the extent permitted by applicable law. If you do not agree to revised Terms, stop using the App and Site.
17. Severability and entire agreement
If a provision is found unenforceable, the remaining provisions remain in effect to the extent permitted by law. These Terms, the Privacy Policy, the Standard EULA, and applicable App Store terms form the agreement governing your use of OneSober.
